Legal Ebay Scam by mahaan
We won an auction for an almost new Sony Digital 8 camcorder, in good working condition, used only 4 or 5 times. It arrived defective (tape got stuck and it wouldn’t play any tapes). We videotaped it with our mini DV camcorder immediately as proof and contacted the seller. He replied back four times telling us to ship it back right away. He even said it was fishy and then used scare tactics, saying we wouldnt get a refund unless we shipped it back right away. He said that he will take it to Sony and if it is a factory default, we will get our money back, if not, we won’t. We argued that it arrived defective and that it had nothing to do with Sony. Sony could not prove who broke it, or if it was broken 1 day ago or 1 year ago. He kept repeating the same thing, to ship it back immediately, He even said he has nothing to lose because he has extended warranty coverage from his American Express (even though this is an older camcorder, no longer made).
So we then took the issue through Paypal Resolution Center, where we showed LOTS of evidence for our case, including an accurate TIMELINE of when the package arrived and how fast we reported that the camcorder was defective. In terms of Sony Digital 8 camcorder EXPERIENCE, I showed how we were experienced using that type of camera since we owned one since last decade and recorded numerous hours of footage. He on the other hand, admitted that he was not a video expert and that he bought it for his girlfriend who left him. He was more likely to break it than us. HISTORY: we have a clean Ebay record. We contacted one of the people who gave him negative feedback, dr_phyll67. dr_phyll67 told us that mahaan shipped him a broken laptop and forgot to send him the power cord. He said that mahaan was SO SLOW in shipping that by the time he was able to test it and complain, it was already too late. He lost his money and said he is willing to testify against mahaan on our behalf. Mahaan also never sent us the firewire cable. NO PROOF THAT THE CAMERA WAS IN EXCELLENT WORKING CONDITION : We proved that we can take the same picture with the defective camera that he showed in his ad, proving that the camera could have been broken when that picture was taken.
The evidence was convincing because Paypal ruled in our favor within 2 days. Paypal asked us to ship the camcorder back to him and provide a tracking number. We did. And because I didn’t trust mahaan, I video taped me packing up the video camcorder and all of the accessories, also showing how well I bubble wrapped the camcorder in case he blamed the shipping. USPS showed that the camcorder arrived on a Monday. I patiently waited for our refund. Nothing happened until Thursday, when I was told that I received the refund. Paypal transferred the money out of his account. But it also said the seller mahaan was appealing. I assumed he was still trying to take it to Sony
HERE IS THE “LEGAL” FRAUD:
Thirteen days go by and we get a message saying that we have a Paypal transaction so we check and the case was closed, but our money was TAKEN AWAY!! NO EXPLANATION AT ALL. I called Paypal and asked what happened. All they could tell me was that mahaan provided “legal documentation” showing that he received a different camcorder! I shipped the correct camcorder and have the video as proof, but it holds no weight compared to his “legal documentation.” I CANNOT dispute or even SEE this document because it is a “legal document”. The case was closed and Paypal said it is out of their hands because of that legal document. They said that I must go through the courts, get a court order and subpoena the document to even see it.
Apparently, mahaan has found a legal way to scam us. How? Friends in the right places?? I don’t know. Thats probably why he didnt care about giving us a lame argument through the Paypal Resolution Center. It didnt matter, because the scam occurs AFTERWARDS. Or before, if you’re naive enough to ship it back. That’s why he was pushing so hard from the beginning to ship it back right away. Ebayers, DO NOT BUY FROM HIM. Lesson learned, we will only buy from power sellers with a very good return policy. We learned that you have NO BUYER PROTECTION against this type of scam.
